A prenuptial agreement may not deal with; custody or visitation of the children, child support, anything "illegal" like most contracts, anything unconscionable (which means the judge has to decide the Agreement is fair for both parties before proceeding ensuring neither side is disadvantaged), or anything that is thought to encourage a divorce. Contrary to popular belief, pre-nuptial agreements may not, by law, encourage divorce.
