If a parent paying child support has fallen behind on payments, interest will build on all amounts owing which is done automatically and cannot be changed by a judge. Failing to pay child support can have very serious consequences and in very extreme cases, can even involve jail time.

Interest on remaining child support payments is calculated as this:

-An additional 10% per year for child support that was due on or after January 1st, 1983; or
-An additional 7% per year for child support that was due before January 1st, 1983.

If your wages are being garnished for child support and you owe for past payments, the interest from these payments will be collected first from your garnishments and additional interest will continue to build on the remaining owed balance.
