Physical vs. Legal Custody

The terms physical and legal custody are self-explanatory to some point. Physical custody essentially means that a parent has the right to the child “physically.” This means that usually if a parent has physical custody over a child, the child will live with that parent. If two parents have joint physical custody over a child, the child will spend significant amounts of time with both parents.

The parent with legal custody can make decisions about religion, schooling, and medical care, for instance. In many states, courts frequently award joint legal custody, which means that the decision making is divided equally.
